The following summarizes the Court’s Opinion: Composition of Total Lipid (‘069) The Court agreed with Plaintiffs’ position that the claimed molar percentage (mol. %) ranges can be met by any particle and is not limited to “finished” particles that are not subjected to further process steps. The Court agreed with Plaintiffs’ position that the claimed mol. % ranges include standard variation based on the number of significant figures recited in the claim. Cationic Lipid with Protonatable Tertiary Amine (‘378) The Court agreed with Plaintiffs’ position that there is no limitation as to the mol. % of the claimed cationic lipid. Die Anordnung ist relevant für die Entscheidung, ob die Impfstoffe von Moderna von der patentierten Technologie von Arbutus abgedeckt sind. "Er entschied in 3 von 4 Patentansprüchen zugunsten der Roivant-Tochter Arbutus... Wir gehen davon aus, dass Moderna vorerst keine Berufung einlegen kann, da es sich nicht um ein formelles 'Urteil', sondern eher um eine 'Entscheidung' wird gehandelt", schrieben die Analysten von Jefferies in einer Mitteilung. Moderna und Arbutus reagierten nicht sofort auf Anfragen von Reuters nach einer Stellungnahme. In der Klage, die im Jahr 2022 (link) eingereicht wurde, fordert Arbutus Schadensersatz wegen Verletzung von US-Patenten im Zusammenhang mit dem Impfstoff COVID-19 von Moderna. Arbutus hat nach eigenen Angaben die so genannten Lipid-Nanopartikel entwickelt, die die mRNA-Nutzlast des Impfstoffs umschließen. Die Patente dazu wurden an Genevant Sciences, ein Joint Venture zwischen Arbutus und Roivant Sciences Ltd. lizenziert. Die Technologie wird eingesetzt, um die RNA zu den Zielzellen zu bringen, ohne dass sie vom körpereigenen Immunsystem angegriffen wird. Die Verhandlung in diesem Fall soll im April nächsten Jahres beginnen.

ABUS won on 4 of 5 patients. “Today’s claim construction order was virtually identical with Arbutus’ proposals for the disputed terms," Rangeley Capital's Chris DeMuth told Seeking Alpha in an interview. "This is a big problem for Moderna heading into a trial that will now literally be fought on Arbutus’ terms. I should disclose that ABUS/ROIV is a top three exposure for me. Today’s opinion is consistent with our thesis that this is valuable IP that ABUS will successfully defend.”

Richtig. Arbutus hat enormes Potenzial. Dennoch ist der Biotech-Sektor unberechenbar. Hier darf man sich leider nie zu früh freuen. Von public offering (dilution) bis zu Studienabbrüchen habe ich schon alles erlebt mit Biotech-Aktien. Es gibt wohl kaum einen Sektor mit vergleichbarer Volatilität.

Nicht zu vergessen was ABUS noch in der Pipeline hat. HBV usw.

Es bleibt spannend. Ich habe arbutus immer als Hedge für meine Positionen bei BioNTech und Moderna gehalten. Hier wird sich dieses Jahr einiges klären. Die nächste Klage wird gegen Pfizer/BioNTech eingereicht.
